Chapter 5 - The Competency Petition

Vanessa's strategy was simple.

If I wouldn't cooperate willingly, they would make me look incapable of managing my own affairs.

Within forty-eight hours, Marcus filed an emergency petition alleging cognitive decline.

He claimed I had become confused after Henry's death.

He claimed I forgot appointments.

He claimed Lily had isolated me.

He even claimed my recent medical condition had affected my judgment.

The betrayal became public.

Neighbors whispered.

A social worker visited.

Then Marcus made his biggest mistake.

He claimed I had voluntarily authorized the $186,000 loan but had “forgotten.”

Rachel nearly smiled when she read that paragraph.

Because Marcus had just connected himself directly to the fraudulent transaction.

We obtained the notary video.

We obtained travel records proving I was in Florida.

We obtained Vanessa's social media photographs.

In one photograph taken two weeks before the fraudulent signing, she wore the same silver ring visible in the remote-notary recording.

Then Lily discovered something even better.

Vanessa had posted a photograph the day of the signing.

Caption:

Handling business while Marcus handles the fun stuff.

She was wearing gray hair beneath a ridiculous costume wig at a themed brunch earlier that afternoon.

Same hair.

Same glasses.

Same ring.

Rachel stared at the photograph.

“Sometimes,” she said, “people document their own crimes beautifully.”

At the competency hearing, Marcus sat across from me.

He couldn't meet my eyes.

The judge reviewed the medical evaluation showing I was cognitively healthy.

Then Rachel played the recording.

Vanessa's attorney objected.

Overruled.

The judge watched silently.

Then came the photograph.

Then the travel records.

Then the loan documents.

By the time Rachel finished, the hearing was no longer about whether I could manage my affairs.

It was about whether my son and daughter-in-law had committed fraud.

Outside the courtroom, Marcus caught my arm.

“Mom, please fix this.”

I pulled away.

“I tried to fix things for you your entire life.”

His face crumpled.

“This could destroy me.”

I looked at him.

“You should have thought about that before you tried to destroy me.”

Behind him, Vanessa screamed my name.

Two courthouse officers stepped between us.

But she wasn't screaming because she was angry.

She was screaming because Rachel had just received a phone call.

The lender had turned the case over to investigators.

And investigators wanted to speak with Vanessa immediately.
